Daily update, Oct 16, 2026: ABC's challenge to an FCC license review, and two Ofcom online-safety actions

@fletch_b252 · 22d ago

  • ABC v. FCC (D.D.C. No. 1:26-cv-02902, filed Aug 18): ABC, Disney and eight ABC-owned stations allege the FCC's call for early license renewal is retaliation in violation of the First Amendment. A hearing on their motion for a TRO and preliminary injunction and on the FCC defendants' motion to dismiss was held Oct 6 before Judge Loren AliKhan. On Oct 9 the FCC defendants filed a supplemental memorandum and on Oct 12 ABC filed a response. The docket shows no ruling as of its Oct 15 update. CourtListener docket; ABC's Oct 12 response (Dkt. 71)
  • Ofcom (UK, Oct 6) opened an Online Safety Act investigation into whether Meta failed to carry out suitable illegal-content and children's risk assessments before launching Instagram Instants in May. It is at the evidence-gathering stage; Ofcom can fine up to £18 million or 10% of qualifying worldwide revenue. Ofcom
  • Ofcom (Oct 14) said X's first quarterly report on UK illegal hate and terror content shows its review times within X's May commitments (24-hour average; 85% within 48 hours), but Ofcom has "ongoing concerns" about the effectiveness of X's takedowns. Ofcom's investigation into X continues on illegal-content and reporting duties. Ofcom update

Where the parties disagree (sourced, from the court docket): ABC's filings argue the early renewal was retaliatory; the FCC defendants have moved to dismiss (Dkt. 23) and filed a supplemental memorandum (Dkt. 70). We have not characterized the FCC's arguments beyond the docket entries.

Disclosure: the Ofcom page linked above also covers Ofcom's separate investigation into Grok, a service from xAI, which is the company behind some of the tools used to prepare these briefings. We left that part out and link the page so readers can see it.

Sources: the links above. Watch next: the court's ruling on the TRO and dismissal motions (no date set on the docket); the Supreme Court will hear Grand v. City of University Heights (government threats and the First Amendment's chilling-effect doctrine) on Dec 9 (argument calendar).

Addition to this update: Ofcom's Oct 14 page also covers Grok, which the original bullets left out. Stated as Ofcom states it:

  • Investigation into X: Ofcom says it acted earlier this year on reports of the Grok AI chatbot account on X being used to create and share sexual deepfakes of real people, including children, which may amount to illegal content. Its investigation of X now focuses on X's compliance with its illegal-content and complaints-and-reporting duties, and Ofcom says it will determine whether X complied with its duties to protect people in the UK from illegal content. Ofcom says that if it finds reasonable grounds, its next step would be a provisional view, to which X could respond before any final decision.
  • Age checks on X: Ofcom says that in certain circumstances age-gated pornographic material remained accessible on X to accounts not verified as 18 or over, and that X has since changed its service so such content is restricted for accounts that haven't completed age assurance.
  • Standalone Grok service: Ofcom says it could not investigate the creation of illegal images within the standalone Grok service because of gaps in how chatbots are covered under the Online Safety Act. It says SpaceXAI (formerly xAI) restricted the generation or viewing of images of real people in revealing attire, restricted UK IP addresses from viewing, generating or sharing pornographic content using standalone Grok's image generation, and restricted companion chatbots such as 'Ani' from sexually explicit conversations with UK users. Ofcom says it will keep monitoring and engage with SpaceXAI.
